At second 24, he grabs the documents from her hand and throws them in the back. IANAL, but from what I understand this act will be interpreted as "he accepted the papers." The plaintiffs probably started celebrating when watching this video.

iAnal also but can "I refused to take the papers" ever be a legally okay excuse for not being served?

Thanks! I'm glad something in the world makes sense!

That’s what the process server is for. They’re there to make sure the target person has the paperwork. Whether the person accepts it or not is irrelevant, the server can swear in the court that the person knows the documents exist and had the opportunity to read them - not that they accepted them.

"This is a TV station, I'm in the middle of being a flaming bigot and lying about immigrants on TV. No, I don't want the lawsuit. No, I don't want the lawsuit. I SAID I DON'T WANT THE LAWSUIT!" (yeets papers)

The interviewer: Fuck me, this is the funniest shit I've seen all week!

He must have been dodging the process servers to the extent that they had to do it on air like this. Like the Texas AG Paxton. You can't just refuse to be served like that though, if they have the right guy, and he touched them, in his hand, that is the standard I think, the papers have to be put in your hand, although many servers don't bother and just throw them near you even if you aren't the person they are supposed to be serving because everyone is bad at their jobs nowadays.

Had a bit of a freak out when I saw the name O'Keefe being used in a conservative/alt right context, because when I think O'Keefe, I think of the musical foundation which teaches kids to make music and produces gems such as this Korn "Freak on a Leash" cover.

I looked them up and the two organisations do not seem to be related, though both feature a (different) person called O'Keefe on their board. Maybe they're related, maybe they aren't. Like how there are two Hershey's in Pennsylvania, USA — one brother made the chocolate company and the other brother made the ice cream company, but they are not the same company, and neither company is going after the other because they do not directly compete and they both have equal right to the name.

Pretty sure the one from the video is named after James O’Keefe, of “dressing like a 70s blaxploitation movie version of a pimp and making a gotcha video that shut down ACORN” notoriety. A real piece of shit, that one.

Man I do not like Korn very much but that was cool.

Their cover of 46&2 is amazing as well. Their cover of Sober is good, but not as good.

[-] JeeBaiChow@lemmy.world 10 points 1 month ago

So easy to bypass the us legal system, huh? Just ignore the papers?

[-] aeronmelon@lemmy.world 35 points 1 month ago

If you can demonstrate that someone (defendant) has been served, either with a witness or photo/video evidence, that person is legally required to appear at the appointed place and time even if they threw it in the trash without reading it. You are only required to present the summons.

If they don’t, the judge will often rule in favor of the plantiff by default.

I have multiple times been served papers for other people with the serving guy demanding all sorts of shit from me, on my own leased property, screaming about being an officer of the court. The guys that do this lie and fail and the courts allow them to, at least around here. The one threw the papers in the hallway, for someone I'd never heard of.

There's no lack of evidence for the MyPillow guy, that's for sure.

Seems like such an archaic law.
