Is it gauche to refer to the US constitution's amendments as a solution?

I mean the 14th. "No person shall be a Senator or Representative in Congress [...] , shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof" should remove a lot of them from office after the last coup.

Considering how often the U.S. Constitution is violated, at this point it should probably be viewed more as a suggestion than a solution.
