That means all those troops were following illegal orders.

[-] bdjukeemgood@lemm.ee 33 points 2 months ago* (last edited 2 months ago)

Lock them all up. Pure evil. Orders should always be considered against the interpretation of law. Don’t they teach these idiots anything in boot camp?

[-] bold_atlas@lemmy.world 4 points 2 months ago* (last edited 2 months ago)

But the the military say they don't follow illegal orders. What's an illegal order? Well they don't really know but they definitely don't follow them!

A federal judge has ruled that President Donald Trump acted illegally in deploying the National Guard to address protests in the Los Angeles area.

In a ruling issued Thursday evening, U.S. District Judge Charles Breyer wrote that such use of the National Guard was a violation of the Tenth Amendment to the Constitution and exceeded the statutory authority granted to the president.

The order, which takes effect Friday, says the administration must return control of the California National Guard to the state of California.

Doesn’t he have immunity now?

[-] Archangel1313@lemmy.ca 63 points 2 months ago

They may not be able to prosecute him, but they can make him stop what he's doing. Theoretically.

[-] Yondoza@sh.itjust.works 14 points 2 months ago

It does seem the power of the judiciary will be challenged quite soon.

It will probably be with a tweet saying "Make me. You and what army?" and the courts will need to rely on the US military choosing the Constitution over the Commander in Chief.

May we all have the fortune to live securely in less interesting times. I suppose it is our duty to make that happen.

[-] M0oP0o@mander.xyz 4 points 2 months ago

It does seem the power of the judiciary will be challenged quite soon.

I think that happened some time ago.

[-] ayyy@sh.itjust.works 6 points 2 months ago

And when he inevitably doesn’t listen they’ll make a really strong pouty face.

Might be true, but since the orders are illegal, the NG are following illegal orders if they continue, meaning potential court martial (depending on many factors).

[-] LillyPip@lemmy.ca 7 points 2 months ago

He does, but anyone following illegal orders doesn’t. Sure, he could pardon them, but only after a long, expensive, and potentially life-changing legal battle after which they’re convicted.

That doesn’t sound like a fight most regular troops should want to gamble on.

The legal system is just not equipped to deal with the threat implied by Trump.

In the US it seems like judges are just another executive arm of the government anyway.

The few actual judges still considering the law just get perpetually paused with appeals and what have you.

At first I was like "this video is 6 years old, how could this possibly be relevant to this conversation?"

Then I watched the video and realized, "yep... same shit, different day." The conservative playbook hasn't changed a bit and Democrats keep falling for it.

[-] EldritchFeminity 6 points 2 months ago

I hate to say this, but you could go back 40 years and this would still be true. 6 years ago, TACO was still in office.

[-] floo@retrolemmy.com 4 points 2 months ago* (last edited 2 months ago)

This world really is worth living in, but we have a lot of work to do.

[-] PunnyName@lemmy.world 8 points 2 months ago

Innuendo Studios becoming more prevalent, and more prescient.

[-] azimir@lemmy.ml 5 points 2 months ago

Way too spot on. The video "How to Radicalize a Normie" should be mandatory study in middle school... Then high school, then every year thereafter.

[-] Archangel1313@lemmy.ca 26 points 2 months ago

So...just let him keep breaking the law until it reaches the Supreme Court? I thought they were supposed to pause his actions, pending appeal...not let him keep going.

[-] ChickenLadyLovesLife@lemmy.world 14 points 2 months ago

just let him keep breaking the law until it reaches the Supreme Court?

Also after it reaches the Supreme Court.

[-] arrow74@lemm.ee 4 points 2 months ago

The Supreme Court has already ruled against him several times this year alone

[-] ayyy@sh.itjust.works 3 points 2 months ago

That doesn’t mean he has to obey those rulings.

The National Guard should release all arrested protesters, return to base and tell the Governor of California that they are "reporting for duty". If not, they are traitors (already before but then even more so).

[-] N0body@lemmy.dbzer0.com 7 points 2 months ago

Temporary order while they consider it. Could still go either way.

[-] SunshineJogger@feddit.org 68 points 2 months ago

The past year doesn't give me the feeling that this will change anything.

Trump is still free and doing his dumbevil stuff

[-] Melvin_Ferd@lemmy.world 26 points 2 months ago* (last edited 2 months ago)

Need more Democrats to sit and wave cardboard signs. Need more protests to run head first into riot shields. Need more leftist to leave social media spaces wide open. Need more Faygo.

Then maybe things will be different

Oh ok, cool. So naturally he's been or will soon be placed under arrest, because that's how being illegal works.

[-] blackstampede@sh.itjust.works 14 points 2 months ago

Not anymore, it's not. He's immune from any sort of prosecution related to the job.

He will just ignore it, and double down. Nothing will happen.

[-] Venus_Ziegenfalle@feddit.org 37 points 2 months ago

Nothing will happen.

The judge might get fired.

[-] azimir@lemmy.ml 6 points 2 months ago

Or at least get right wing death threats and have any security stripped away, followed by being doxxed by the head of the judicial branch and DOJ.

[-] TipRing@lemmy.world 13 points 2 months ago

The question is whether the California National Guard will follow Trump's orders or Newsom's orders in a situation where a court has ruled that Newsom is who they currently work for.

[-] Mouselemming@sh.itjust.works 5 points 2 months ago

It's been paused on appeal...

[-] Lost_My_Mind@lemmy.world 42 points 2 months ago

"Oooooohhhhhh, you broke the law, president trump!"

".......yeah? And?"

And nothing happened.

[-] KingJalopy@lemm.ee 13 points 2 months ago

No no you don't understand... The PRESIDENT broke a law... This is like yuge. America won't stand for this.

Jkjk this is just Thursday, tune in tomorrow night for night TGIF! If I haven't seen it, it's new to me!

[-] PunnyName@lemmy.world 8 points 2 months ago

Hello fellow millennial or older.

[-] ArchmageAzor@lemmy.world 40 points 2 months ago

I'm sure that means there will be repercussions

[-] fluxion@lemmy.world 10 points 2 months ago

Jail time, no doubt

[-] Deceptichum@quokk.au 28 points 2 months ago

Okay?

Nothing matters without a consequence. Show me a judge who will put a warrant out on Trump and enforce it.

[-] Mouselemming@sh.itjust.works 9 points 2 months ago

It's paused on appeal now, but there was never going to be a consequence for Trump personally because he'd argue "official act." There'd only be the return of control of the CA National Guard troops to Governor Newsom So they could be sent to help with wildfire situations, for instance. Then again, will people even trust them to help with an evacuation anymore?

[-] phx@lemmy.ca 4 points 2 months ago

Yeah, everyone should remember that the Supreme Court fucked you all by paving the way for this, and the rest of the Legislative branch as well by either ignoring their duty or actively supporting a massive overreach in power and outright ignoring existing limits.

[-] RememberTheApollo_@lemmy.world 26 points 2 months ago

Wouldn’t it be nice if rulings against the talibangelical dictatorship actually carried any weight anymore?

[-] DanVctr@sh.itjust.works 7 points 2 months ago

Y'all Qaeda at it again

[-] QueenHawlSera@sh.itjust.works 21 points 2 months ago

Awesome, so... I don't expect him to be arrested or impeached, or for there to even be an investigation or anything.

I'm hoping for something more realistic like taking away his screen time for the weekend, or at least till he says he's sowwy.
