Justice is absent here.

I've read the opinion a few times. SCOTUSBlog has a better summary (https://www.scotusblog.com/2026/06/court-rules-for-roundup-maker-in-dispute-over-cancer-warnings-on-pesticide-labels/). It really came down to the preemption argument, which Justice Jackson addresses in the dissent.

I'm disappointed Bayer came out on top, of course, but I felt this case was doomed from the get go as the evidence isn't great and many health authorities, including the WHO, don't link it directly to any cancers. That and the political climate and business interests made this an uphill battle. Yet, I predict it will exacerbate already deep mistrust of BigAg and Federal relationships, further eroding trust in SCOTUS as well. Monsanto, now houses within Bayer, is not a loved company for what they've done to farmers and seed usage rights.

But the dissenting opinions are quite good. Gorsuch and Jackson aren't two I expected to see join on this one.
