The claim comes after months of President Trump toying with the idea, insisting that he is “not joking” about defying a constitutionally-mandated term limit.

The constitution is crystal-clear:

Twenty-Second Amendment

Section 1

No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President when this Article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term.

Section 2

This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several States within seven years from the date of its submission to the States by the Congress.

You don’t build a throne room to yourself if you are leaving. The minute the SC gave him universal immunity - it was over. He’s not leaving because he might face a consequence. He will remain in power until he leaves, in a box.

This was all avoidable.

[-] Tm12@lemmy.ca 30 points 1 day ago

No fucking shit. He has merch.

[-] rainbowbunny@slrpnk.net 1 points 19 hours ago

Well the merch is just a joke to own the libs!

[-] NABDad@lemmy.world 21 points 1 day ago

He can't legally be elected president, but he could be made speaker of the house and the elected president and vice president could both resign (or be eliminated) making him president.

Or, Congress could change the order of succession such that Trump becomes president without being speaker of the house.

I would hope the various numbnuts I know who claim he isn't trying to become king figure out they were wrong before it comes to pass.

[-] notabot@piefed.social 11 points 1 day ago

As far as I can see, he could just run as V.P. to some candidate whose entire platform is "I will resign straight after being sworn in." A disturbing number of people would vote for them just to "own the libs".

[-] LastYearsIrritant@sopuli.xyz 15 points 1 day ago

No, you have to be eligible to be president to be VP. It's just as illegal as running as president.

[-] notabot@piefed.social 1 points 1 day ago

Ah, OK, that's good to know. So, speaker of the house is the most likely under current arrangements. I wonder if thaat's the plan, or if they're going to try to change the rules, or if they're just going to ignore the rules completely.

[-] NotMyOldRedditName@lemmy.world 5 points 1 day ago* (last edited 1 day ago)

from what I recall, it's written in a way that even in that circumstance they wouldn't be able to become president, it would move down to the next person, but he absolutely could be speaker of the house.

[-] firebyte@lemmy.world 6 points 1 day ago* (last edited 1 day ago)

Here's a thought...

Let's say someone - like JD Vance - wins the presidency on an 'I'll resign on Day 1 and nominate Speaker Trump to take my place' ticket (assuming the succession rules are changed too).

Why would he? Why would someone willingly give up the unchecked power of the most powerful person on the planet?

We've seen just how completely broken the U.S. is now, effectively having a king thanks to the Supreme Court. The first 'official' act of this new President, before they chose to resign, would be to release the Epstein files, arrest Trump, and put him on trial for all of his crimes.

That way they keep all of this unchecked power to themselves.

[-] Corporal_Punishment@feddit.uk 2 points 1 day ago

You're asking why?

Because Vance is a fucking cuck thats why.

[-] CharlesDarwin@lemmy.world 4 points 1 day ago

I think if "JD" "Vance" were to actually do something like that, he'd have to watch out for the actual Deep State that would be aching to do a JFK to him because of their absurd loyalty to Orange Jesus.

[-] firebyte@lemmy.world 3 points 1 day ago

That's what I would've thought...

Though would the vehemently anti-paedophile Deep State suddenly forget about Trump when the Epstein Files are released?

I'm genuinely not so sure their blind faith in Orange Jesus will remain resolute when even MTG is demanding their release.

[-] paranoid@lemmy.world 4 points 1 day ago

In (I think) the 12th amendment, it states that anyone who is ineligible to run for president is also ineligible to be vice president. While it's not necessarily clear, I imagine that'd also mean that anyone ineligible to run for president would not be eligible for any position that would put them in line of succession for president

[-] whiwake@sh.itjust.works 2 points 1 day ago

He will be the first third term president. He will not need to be elected

[-] NABDad@lemmy.world 7 points 1 day ago

If it does happen, he would be the second.

FDR beat him to it, but legitimately.

[-] Wilco@lemmy.zip 4 points 1 day ago

FDR was elected for 4 terms.

[-] NABDad@lemmy.world 3 points 1 day ago

Exactly. It makes him the first President elected to four terms and he is also the first President elected to three terms.

[-] whiwake@sh.itjust.works 2 points 1 day ago

Yes, I forgot about FDR

Trump will leave office when he’s dead.

[-] Alexstarfire@lemmy.world 2 points 1 day ago

Might want to check out FDR.

[-] whiwake@sh.itjust.works 1 points 1 day ago

Oh shit I forgot all about FDR.

[-] CharlesDarwin@lemmy.world 7 points 1 day ago

I'd love someone to ask Bannon off the record if he really thinks Taco's health suggests he'll make it another 3.5 years.

[-] whiwake@sh.itjust.works 5 points 1 day ago

Just because as a person is having mental decline, and possibly a stroke, doesn’t mean they can’t be kept alive for decades with the best medicine money can buy

[-] bufalo1973@piefed.social 1 points 1 day ago

The Golden Throne doesn't exist... yet.

[-] whiwake@sh.itjust.works 2 points 20 hours ago

lol, I was just about to say I am pretty sure Trump has a golden toilet

[-] ILikeBoobies@lemmy.ca 1 points 1 day ago

Or continue to release ai videos until they get bored of it.

[-] eveskeets@lemmy.world 1 points 1 day ago
