afaik it's by election only now to fill a vacant senate seat from kentucky. the republicant super-majority in that state legislature passed a law that took the governor, including the sitting 2-term democrat, out of that process.
Yup, they passed it specifically last April to stop Beshear from appointing anyone.
Now, TECHNICALLY this might garner a challenge in the state Supreme Court - it didn't amend the state constitution, which says the governor can appoint for vacant seats.
the inevitable court case would go on longer than turtle's term.

You are correct the seat, no matter what, would sit vacant until a special election is held
