TLDR If I get arrested for being topless as a trans women the outcome would either be
1: it's illegal, which would be a win for trans women as we would be considered closer to cis women, or
2: it's legal which would be a win for free the nipple movement because it could be argued "that trans women can do it and their boobs are the same as ours"

Where I live, If you went to a public space topless where it wasn't the norm (beach or swimming pool basically) you would be approached by police regardless of gender

It's pretty easy what their frame is:

The in-group is free to do what it wants.
The out-group can't do anything.

Rules are mainly enforced and biased against the out-group.

To make them realise, you'll first need to make them feel like they're not part of the in-group.

And use their own loyalty against themselves. Tell them that Trump wants them to vote Dem. Etc.

I'm neither Scottish nor ultra-deeply embedded into the trans community, so I doubt I would've heard of politician statements or the like. But yeah, I do think I would've heard of it, if the ruling got repealed, and I did not hear of that, unfortunately.

I guess, the main aftermath is that it got reported pretty much globally, because it is clever and there are boobs involved, so even clickbait newspapers can print that. Well, and hopefully it got people talking and reevaluating their preconceptions.

The point is transphobia. They will just use it as an excuse to persecute you, without giving the slightest bit of consideration to you. In the same way that the UK is trying to ban trans folk from using any gendered toilet. The point is the discrimination, they don't give a shit about "gotchas"

The push for the rulling was that the word "woman" in the equality act, should apply only for those assigned female at birth. So they would have to use their assigned at birth gender. Do note that they only ever shouted loudly about trans women, never that a trans man would be using the mens instead.

in some circumstances the law also allows trans women (biological men) not to be permitted to use the men’s facilities, and trans men (biological woman) not to be permitted to use the women’s facilities

Breaking news from the Florida Supreme court: EVERYONE must wear either a shirt which fully covers the nipples and belly-button or a wool turtleneck sweater in public in Florida, at all times, from now on, including at the beach, regardless of gender, sexuality or minority skintone, according to the new 'no nipples' nevenude law. I'm not familiar with Florida laws but in much of the US anyone can legally be topless under certain conditions. I think it's usually exposed genitalia and sexual intent that are specifically illegal but general toplessness without sexual intent that isn't creating public disorder isn't something you are likely to be prosecuted for. You could get harassed and possibly arrested but it's unlikely to go further than that. If you really want to do this you should consult with an attorney to get prepared ahead of time.
