It is not like we do not have the capability to take these guys alive and throw them into the criminal justice meat grinder. It would be better press for them.

But they are trying to set precedents. Leading up to grabbing American citizens and disappearing them, or just summary execution. That is exactly where they want to go.

War crimes also included deliberate attacks on citizens and property of neutral states, such as the Japanese attack on Pearl Harbor. The idea is probably to trigger a small war. It's not the first time some leader is doing a war as a distraction and to give the people a common enemy. Some also like to send the people they don't like to that war. It usually works in short term and ends in disaster in long term.
