the driver is charged but the company... not liable at all? if i use a toaster and it explodes and kills my next door neighbour, should i be arrested or should the toaster manufacturer?

It depends. Does the toaster brand have a known, documented history of doing exactly that and you bought it anyway? Also, is the toaster company run by a Nazi?
Yeah, but in this case it's more like if you threw your toaster at your neighbor's head killing him.
