I think theres a stigma around that rule more than it has anything to do with it being libertarian. The later bars are allowed to be open the worse of a look it gives the neighborhood. It could bring unwanted types of people in since those are the only people they believe would be drinking at 3am, as well as additional noise which could be disruptive if the bar is located next to residential places. I think its just seen as a bad look which is why its restricted. I am also someone who doesn't really care, but i guess location should matter in what time is the latest it can stay open. I grew up visiting NY a lot and they are a perfect example of who cares what time a bar closes and it was wonderful.
