It doesn't.

They just hate AI in principle and make shit up. AI could introduce this and that 🙄. But yeah I'm sure Bob out of code boot camp is sooooo much better 🙄. Or that somehow having AI let's Nintendo sic their legal team on projects 🤣.

It's a lost cause and they'll just happily gimp themselves and make their life harder while screeching at users.

Since the models have used any source available that they could grab on, it's possible that it would also give out leaked and copyrighted source code which even after a console released 17 years ago could bring it into harm's way

Stop parroting this nonsense. This is already settled law. Goggle already fought this fight. If they want to bury a project in legal it'll be from another angle.
