Bullshit "consent" from some contract-of-adhesion ToS of a commercial third-party that no reasonable person would expect to be affiliated with the Secret Service shouldn't have been considered good enough even if they had verified it. They ought to be required to get an actual warrant to collect information like that!

This isn't just them failing to dot their t's and cross their i's in some administrative oopsie; this is them massively violating tons of people's Fourth Amendment rights on a grand scale.

Furthermore:

The Secret Service added it had not been obtaining a warrant before using Locate X. The agency also said it had used the tool “to assist with developing leads and intelligence,” and that it had not been used in prosecutions.

That's some bullshit in and of itself. The Fourth Amendment does not only apply to prosecutions!
